Terms of Service

These Terms of Service govern your access to and use of Auliqo, an AI-assisted grading service operated by Auliqo. By creating an account or using the service, you agree to be bound by these terms. If you do not agree, do not use the service.

1. Definitions

"Service" means the Auliqo web application, APIs, and related features offered at auliqo.ai.

"You" or "Customer" means the individual or institution that creates an account and uses the Service.

"Instructor" means a user with permission to create rubrics, submit student work for AI review, and post grades.

"Credit" means the consumable unit billed by the Service for each AI review run.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By creating an account you confirm that the information you provide is accurate and that you are authorized to bind your institution if you sign up on its behalf.

You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

3. The Service and instructor responsibility

Auliqo produces AI-generated suggested scores and feedback against rubrics you define. The Service is a decision-support tool. Final grades are always set by the Instructor.

You agree not to represent AI output as a final grade without instructor review, and to comply with any disclosure obligations your institution or jurisdiction imposes when AI is used to evaluate student work.

4. Acceptable use

You may not use the Service to:

  • Violate any law or third-party right, including intellectual property and privacy rights.
  • Upload content you do not have the right to submit, including student work submitted without the consent required by your institution.
  • Attempt to reverse engineer, scrape, or interfere with the Service or its infrastructure.
  • Use the Service to build a competing product or to train a third-party model.
  • Submit content that is unlawful, harmful, or violates the policies of the underlying AI providers.

5. Subscriptions, credits, and billing

The Service is offered on a subscription basis with a monthly allotment of Credits. Additional Credits may be purchased as top-ups. Credits expire as stated at the time of purchase.

Billing is handled by Paddle.com Market Limited and its affiliates ("Paddle"), our authorized Merchant of Record. Paddle issues your receipt, charges applicable taxes, and processes refunds. By purchasing, you also agree to Paddle's checkout terms.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current period.

6. Refunds

Refund eligibility is described in our Refund Policy. In summary: first-time monthly subscriptions are refundable within 7 days of the initial charge provided fewer than 25% of included Credits have been consumed. Consumed Credits and top-ups are non-refundable. Statutory rights under EU/UK consumer law are unaffected.

7. Intellectual property

You retain all rights to the rubrics, student work, and other content you upload ("Customer Content"). You grant Auliqo a limited, worldwide, royalty-free license to host, process, and transmit Customer Content solely to operate and improve the Service for you.

Auliqo and its licensors retain all rights to the Service software, models, and brand. You receive a non-exclusive, non-transferable right to use the Service in accordance with these terms.

8. Third-party AI providers

The Service uses third-party AI model providers to generate suggested grades and feedback. By using the Service, you authorize Auliqo to transmit relevant Customer Content to those providers solely for that purpose, under contractual terms that prohibit the providers from training their models on your data.

9. Warranties and disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Auliqo disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of AI output, and non-infringement.

AI output may be inaccurate, incomplete, or biased. You are responsible for reviewing every suggested grade before posting it.

10. Limitation of liability

To the maximum extent permitted by law, Auliqo's total liability arising out of or relating to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim. Auliqo is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or grades.

Nothing in these terms limits liability that cannot be excluded under applicable law, including for fraud, gross negligence, or wilful misconduct.

11. Termination

You may stop using the Service at any time and close your account from settings. We may suspend or terminate access for material breach of these terms, with notice where practicable. On termination, your right to use the Service ends and we will delete Customer Content within a reasonable period, subject to legal retention requirements.

12. Changes to the Service or terms

We may update these terms from time to time. Material changes will be communicated by email or in-product notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law and disputes

These terms are governed by the laws of the Republic of Guatemala, without regard to its conflict-of-laws rules. Disputes shall be brought before the competent courts of Guatemala City, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
